Proformance Sports Terms of Service

1. Accounts and Memberships

Users may be required to create an account to access certain services or bookings. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity conducted through your account.

2. Booking, Cancellation and Attendance Policy

• Classes, coaching sessions, and facility bookings may be subject to availability.
• Cancellations must be made at least 12 hours before the scheduled session unless otherwise stated.
• Late cancellations or no-shows may result in forfeiture of the session or applicable charges.
• Clients are encouraged to arrive at least 5 minutes before scheduled sessions.

3. Health and Safety

By participating in any training, fitness, sports, wellness, or recovery activity, you acknowledge that physical exercise carries inherent risks including injury, illness, or death.

You confirm that:

• You are medically fit to participate.
• You will inform Proformance staff of any injuries, medical conditions, or limitations.
• You voluntarily participate at your own risk.

Proformance reserves the right to refuse participation where safety concerns arise.

4. Recovery and Wellness Disclaimer

Recovery and wellness services provided by Proformance, including but not limited to sauna, cold plunge, mobility, breathwork, and recovery-related activities, are not medical treatments and are not intended to diagnose, treat, cure, or prevent any medical condition. Clients should consult a qualified medical professional before participating where appropriate.

5. Studio and Facility Rules

Clients must:

• Follow all instructions from coaches and staff.
• Use equipment safely and responsibly.
• Wear appropriate athletic attire and footwear.
• Treat staff, members, and guests respectfully.

Harassment, abusive behaviour, discrimination, or unsafe conduct may result in immediate suspension or termination of access without refund.

6. Photography and Media Consent

By entering the premises or participating in Proformance activities, you acknowledge that photographs, videos, or recordings may be taken for marketing, promotional, operational, or social media purposes. You consent to the use of such materials by Proformance unless you notify us in writing otherwise.

7. Personal Property

Proformance is not responsible for any loss, theft, or damage to personal belongings brought onto the premises. Clients are advised not to leave valuables unattended.

8. Payments, Memberships and Refunds

• All fees are payable in Singapore Dollars (SGD).
• Memberships, packages, and sessions are non-transferable unless approved in writing.
• Payments made are generally non-refundable except where required under Singapore law.
• Proformance reserves the right to revise pricing and membership structures at any time.
• Membership freezes, extensions, or suspensions may be granted at Proformance's discretion subject to applicable policies.

9. Minors

Users under 18 years old must obtain consent from a parent or legal guardian before participating in Services.

10. Medical Emergencies

In the event of a medical emergency, Proformance may seek emergency medical assistance on behalf of the participant where reasonably necessary.

11. Intellectual Property

All website content, branding, training systems, videos, graphics, logos, documents, and materials are owned or licensed by Proformance and are protected under Singapore intellectual property laws.

You may not reproduce, distribute, modify, or commercially exploit any content without prior written consent.

12. Privacy and Website Data

Personal data collected by Proformance will be handled in accordance with the Singapore Personal Data Protection Act 2012 ("PDPA").

By using our Services, you consent to the collection, use, and disclosure of your personal data for operational, marketing, administrative, and service-related purposes.

Our website may use cookies, analytics tools, pixels, and related technologies to improve user experience and marketing performance.

13. Limitation of Liability

To the fullest extent permitted under Singapore law, Proformance and its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Services or facilities.

Clients acknowledge that participation in physical training and recovery activities involves inherent risks and voluntarily assume such risks.

Nothing in these Terms excludes liability that cannot legally be excluded under Singapore law.

14. Suspension and Termination

Proformance reserves the right to suspend or terminate memberships, bookings, or access to Services at its discretion for breaches of these Terms, misconduct, non-payment, or safety concerns.

15. Third-Party Services

Our Services may include third-party booking systems, payment gateways, or external providers. Proformance is not responsible for third-party systems, websites, or services.

16. Force Majeure

Proformance shall not be liable for delays, interruptions, closures, or failure to perform arising from events beyond its reasonable control, including but not limited to acts of God, government restrictions, power failures, pandemics, or maintenance issues.

17. Amendments

We may amend these Terms from time to time. Updated Terms will become effective upon publication on our website or notification to clients.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Singapore.

19. Promotions and Giveaways

Any promotions, discounts, competitions, or giveaways conducted by Proformance are subject to separate campaign-specific terms and Singapore promotional regulations where applicable.

Proformance reserves the right to amend, suspend, or terminate promotions at any time.
